Florida Wrongful Death Act

Statute of Limitations

However, where the statute of limitations for the decedent's underlying personal injury claim has run out prior to the decedent's death, then a wrongful death action arising from the same tortious incident will also have lapsed.

According to section 768.21, Florida Statutes, a decedent's survivors may recover one or more of the following damages:

  • loss of past and future support and services, such as loss of financial support and the unavailability of household assistance with chores or maintenance;
