Unfortunately, there are times an insurance company may act in bad faith. An insurance company’s conduct may constitute bad faith when it

  • Fails to promptly or thoroughly investigate a claim;
  • Refuses to settle a case;
  • Refuses to provide its insured legal representation through a “reservation-of-rights” while coverage is remains uncertain;   
  • Unreasonably delays the payment of benefits;
  • Wrongfully denies a claim;
  • Uses a stalling tactic—the most common being when a claimant’s case is passed around to different adjusters;
  • Uses an unreasonable interpretation of the policy’s terms in order to deny a valid claim; or
  • Pay only partial benefits rather than full benefits.
